Worker's Compensation Reimbursement Judgment
Fleishman & Shapiro, P.C. was able to obtain a judgment on
behalf of a client requiring his worker’s compensation carrier to
pay him in excess of $800,000. The award was for reimbursement to
the client for the attorney fees he paid in prevailing at trial
against a third party who injured him in an automobile collision.
The worker’s compensation carrier was able to stop paying all of the
client’s future benefits based on the verdict obtained for the
client in the automobile collision lawsuit against the third party.
Therefore, the Court determined that the worker’s compensation
carrier should pay to the client a portion of the attorney fees the
client spent in the third party lawsuit which allowed the worker’s
compensation carrier to stop making benefit payments to the client.
